Extended Warranty for new, repaired or upgraded Audreys.
Instructions. This Contract is available for purchase to residents of the United States of America, except for Alaska, Maine, or U.S. Territories including Guam, Puerto Rico and U.S. Virgin Islands.
To Obtain Service. Contact AudreyUpgrade.com at warranty@audreyupgrade.com for instructions on returning your Audrey to us. Be prepared to tell us the nature of the problem. You must contact AudreyUpgrade.com prior to having service; all repairs must be authorized in advance. We will not reimburse you for work done by unauthorized servicers or others. Unauthorized repairs may not be covered. Service will be initiated within 48 hours of your receipt of your Audrey and will be completed as soon as reasonably possible.
What Is Covered. Eligible products include new merchandise purchased from AudreyUpgrade.com and used merchandise serviced by AudreyUpgrade.com for repair or upgrade. This Contract covers parts and labor costs resulting from a mechanical or electrical failure of the Product caused by defects in workmanship and/or materials, including those manifesting from normal wear and tear. You are responsible for shipping or delivery to Our service center or replacement facility.
We will repair or replace the Product with one of equal or greater value, or reimburse you for authorized repairs to or replacement of the Product, at our discretion, when required due to a Breakdown, including those experienced during normal wear and tear, which is not concurrently covered under any other warranty or service contract or any insurance policy. Note: Repair or replacement due to damage manifesting from power surges shall be provided as secondary coverage to any other warranty, service contract or insurance policy. In such a case, this contract will cover any applicable deductible. Non-original manufacturer's parts may be used for repair if original parts are unavailable or more costly. Commercially used products are not covered under this program.
Term of Coverage . Coverage commences from the date the Product is shipped from us to You for a period of one year, two years or three years depending on the length of service contract purchased, but in no event shall total coverage surpass a maximum of thirty-six (36) months from date of purchase. Shipping costs are not included under this Contract and need to be paid by You.
Limit of Liability. For any single claim, the limit of liability under this Contract is the least of the cost of (1) authorized repairs, (2) replacement with a Product or equal or greater value, (3) reimbursement for authorized repairs or replacement, or (4) the price that You paid for the Product. The total liability under this Contract is the purchase price You paid for the Product; in the event We replace the Product or reimburse you for replacement of the Product with another Product of equal or greater value, We shall have satisfied all obligations owed under this Contract.
WHAT IS NOT COVERED. (1) INCIDENTAL OR CONSEQUENTIAL DAMAGES INCLUDING BUT NOT LIMITED TO ANY DELAY IN RENDERING SERVICE UNDER THIS CONTRACT OR FOR LOSS OF USE DURING THE PERIOD THAT THE PRODUCT IS AT A REPAIR CENTER OR OTHERWISE AWAITING PARTS; (2) ANY AND ALL PREEXISTING CONDITIONS THAT OCCUR PRIOR TO THE EFFECTIVE DATE OF THIS CONTRACT; (3) DAMAGE FROM ACCIDENT, ABUSE, MISUSE, INTRODUCTION OF FOREIGN OBJECTS INTO THE PRODUCT, UNAUTHORIZED PRODUCT MODIFICATIONS OR ALTERATIONS; (4) FAILURE TO FOLLOW THE MANUFACTURER'S INSTRUCTIONS; (5) THIRD-PARTY ACTIONS (FIRE, COLLISION, VANDALISM, THEFT, ETC.); (6) THE ELEMENTS OR ACTS OF GOD; (7) WAR, INVASION OR ACT OF FOREIGN ENEMY, HOSTILITIES, CIVIL WAR, REBELLION, RIOT, STRIKE, LABOR DISTURBANCE, LOCKOUT OR CIVIL COMMOTION; (8) DAMAGE WHICH IS NOT REPORTED WITHIN 30 DAYS AFTER EXPIRATION OF THIS CONTRACT; (9) PHYSICAL OR LIGHTNING DAMAGE TO A SATELLITE DISH (NOT THE RECEIVER); (10) COMMERCIALLY-USED PRODUCTS; (11) DEFECTS KNOWN AS THE "YEAR 2000 PROBLEM", "MILLENNIUM BUG", OR "YEAR 2K"; (12) DAMAGE CAUSED BY DEFECTIVE BATTERIES OR REPLACEMENT OF DEFECTIVE BATTERIES; (13) DAMAGE COVERED BY OTHER WARRANTY OR SERVICE CONTRACT OR INSURANCE (IN SUCH A CASE, THIS CONTRACT WILL COVER ANY APPLICABLE DEDUCTIBLE); (14) COST OF INSTALLATION, REMOVAL OR REINSTALLATION OF THE PRODUCT; (15) ANY LOSS OTHER THAN A COVERED BREAKDOWN OF THE PRODUCT; (16) PRODUCTS NOT ORIGINALLY COVERED BY A MANUFACTURER'S WARRANTY; (17) NON-FUNCTIONAL OR AESTHETIC PARTS INCLUDING BUT NOT LIMITED TO PLASTIC PARTS OR KNOBS; (18) SCRATCHES, PEELING AND DENTS; (19) UNAUTHORIZED REPAIRS AND/OR PARTS; (20) PARTS FAILURE DUE TO A MANUFACTURER RECALL; (21) DAMAGE, WARPING, OR RUSTING OF ANY NON-OPERATING PART; (22) LOSS OR DAMAGE RESULTING FROM THE FAILURE TO PROVIDE MANUFACTURER'S RECOMMENDED MAINTENANCE OR TO MAINTAIN THE INTEGRITY OF THE PRODUCT; (23) PRODUCTS WITH REMOVED OR ALTERED SERIAL NUMBERS.
Definitions. (1) We/Us/Our: The company obligated under this Contract, as indicated in the "Obligor" section of this Contract; (2) AudreyUpgrade.com, the administrator of this Contract; (3) Breakdown: The mechanical or electrical failure of the Product caused by defects in workmanship and/or materials; (4) Product: The consumer item(s) which You purchased concurrently with and is covered by this Contract; (5) You: The individual who purchased the Product and this Contract, or the authorized assignee.
Transfer. This Contract may be transferred. You may transfer the balance of this Contract by contacting AudreyUpgrade.com. at warranty@audreyupgrade.com . Information provided by You must include the Product serial number, date of transfer, new owner's name, complete address and telephone number.
Insurance . This is not a contract of insurance.
Entire Contract . This Contract, including the terms, conditions, limitations, exceptions and exclusions, and the product serial number, for Your Product constitute the entire agreement. Your rights under this Contract may vary from state to state.
Endorsements . Any endorsements provided with this Contract supersede the applicable general terms and conditions shown above.
Arbitration. Any controversy or claim arising out of or relating to this Contract, or breach thereof, will be settled by binding arbitration in accordance with the Commercial Arbitration Rules of the American Arbitration Association. A judgment upon the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof. The parties specifically agree to the binding nature of the arbitration.
ARIZONA ONLY: No claim incurred or paid will be deducted from the amount to be returned in the event of cancellation. In the "WHAT IS NOT COVERED" section of this Contract, exclusion (2) does not apply in the state of Arizona.
CALIFORNIA ONLY: Informal dispute resolution is not available.
CONNECTICUT ONLY: If You purchased this Contract in Connecticut, You may pursue arbitration to settle disputes between You and the provider of this Contract. You may mail your complaint to: State of Connecticut, Insurance Department, P.O. Box 816, Hartford, Connecticut 06142-0816, Attention: Consumer Affairs. The written complaint must describe the dispute, identify the price of the Product and cost of repair, and include a copy of this Contract. The term of this Contract will be automatically extended for the period during which the Product is in the custody of a service center for repair. You may cancel this Contract if You return the product or the product is sold, lost, stolen, or destroyed.
MICHIGAN ONLY: If performance under this Contract is interrupted because of a strike or work stoppage at our place of business, the effective period of the Contract shall be extended for the period of the strike or work stoppage.
NORTH CAROLINA ONLY: You understand that the purchase of this Contract is not required to purchase or to obtain financing for the Product. We or AudreyUpgrade.com. may not cancel this Contract except for nonpayment by You or for violation of any of the terms and conditions of this Contract.
OKLAHOMA ONLY: This Contract is not issued by the manufacturer or wholesale company marketing the product covered by this Contract. This Contract will not be honored by such manufacturer or wholesale company.
OREGON ONLY: Service must be initiated within forty-eight (48) hours from receipt of Your service request under the Contract.
TEXAS ONLY: If you purchased this Contract in Texas, unresolved complaints concerning a provider or questions concerning the registration of a service contract provider may be addressed to the Texas Department of Licensing and Regulation, P.O. Box 12157, Austin, Texas 78711, telephone number (512) 463-2906 or (800) 803-9202.
WYOMING ONLY: In the state of Wyoming, arbitration can only be final and binding if agreed to by the parties involved, in a separate written agreement.
